These Terms of Use (“Terms”) govern your use of the website and services offered by BAR Health Coaching, LLC (“Company,” “we,” “us,” or “our”), including all content, features, and tools available through the website located at BarHealthCoaching.com (the “Site”). By accessing or using the Site and/or otherwise engaging with our health consulting services (the “Services”) (including without limitation any personalized services the Company may provide to you, whether through the Site, by telephone, video conference, in person or otherwise), you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you should not use the Site or Services.

1. Services Provided
The Company provides online health coaching services, which may include personalized consultations, wellness coaching, health advice, and educational resources on various health topics. Our services are intended to provide general information and support, and are not intended to replace professional medical advice, diagnosis, or treatment.
The Company does not provide medical or physical therapy advice or services. Neither the Company nor its personnel are registered nutritionists or registered dietitians.

2. Eligibility
In order to use our Services, you must either (1) be at least 18 years old; or (2) have the consent of a parent or guardian who is at least 18 years old. By accessing or using the Site, you represent and warrant that you meet one of these two conditions.

3. Consultation Disclaimer
While we provide health advice and recommendations through our Services, all information provided is intended for general informational purposes only. Our services are not a substitute for professional medical advice, diagnosis, or treatment. You should consult with a qualified healthcare provider before making any decisions related to your health.
No Medical Advice: The information provided through the Services is not a substitute for professional medical care. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition.
No Doctor-Patient Relationship: Your use of our Services does not establish a doctor-patient relationship with the Company or any person providing Services on behalf of the Company.

4. Privacy and Confidentiality
We take your privacy seriously. We will not share any of your private, confidential personal information that we learn in connection with providing the Services to you, except: (i) as reasonably necessary to provide Services to you; (ii) to collect amounts owed to us by you or owed to in connection with our provision of Services to you; and/or (iii) as required by applicable law.
Medical Information: We will handle any personal health information you provide to us with the utmost care and confidentiality. However, please be aware that no electronic communication is fully secure, and while we strive to protect your information, we cannot guarantee the security of your data.

5. User Responsibilities
You agree that you will:
Provide to the Company accurate, complete, and up-to-date information about yourself and your health during consultations and when using the Site.
Use the Site and Services only for lawful purposes.
Not use the Site or Services in any way that could damage, disable, overburden, or impair the Site or Services, or interfere with any other party's use of the Site or Services.
Respect the confidentiality of any other user’s personal information.

6. Payment and Fees
Fees: Some Services may require payment. Fees for consultations or packages will be clearly outlined on the Site or at the time of booking.

7. Cancellation and Rescheduling
You may cancel or reschedule a consultation within 24 hours of the scheduled appointment. If you cancel or reschedule within this period, you will incur a cancellation fee of $50.

8. Intellectual Property
The content on the Site, including but not limited to text, graphics, logos, images, articles, videos, and software, is owned by the Company and is or may be protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or modify any content without prior written permission from the Company.

9. Fees For Referrals and Products; No Liability to the Company or its Agents
The Company may provide introductions, referrals, or links to third parties and third-party products and services. The Company may receive fees for doing so, and those fees are the property of the Company. You agree the Company has no liability for the acts or omissions of any such third parties, and has no liability with respect to any third-party products and services. You also agree that the decision to engage any such third party or to purchase any such third-party products and services is yours, and not the Company’s or any of the Company’s agents. You also agree that the provisions of paragraphs 10 and 11 apply to and protect the Company according to the terms of those paragraphs with respect to any such third-parties and/or third party products or services engaged, purchased, or used by you.

10. Limitation of Liability
To the fullest extent permitted by law, the Company and its affiliates, officers, manager, employees, and agents are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services, including but not limited to any health-related outcomes or decisions made based on the information provided through the Services.

11. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, manager, employees, and agents from and against any and all claims, damages, liabilities, and expenses (including legal fees) arising out of or in connection with your use of the Site, Services, or any violation of these Terms.

12. Modification of Terms
We reserve the right to update, modify, or revise these Terms at any time. Any changes will be posted on the Site with an updated effective date. Your continued use of the Site and Services after the changes are posted will signify your acceptance of the revised Terms.

13. Termination
We reserve the right to suspend or terminate your access to the Site or Services at any time, without notice, for any reason, including if we believe you have violated these Terms.

14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any disputes arising from these Terms shall be resolved through arbitration in Arlington County, Virginia.
